Returns / Store Credit Policy

This Returns / Store Credit Policy applies to purchases made from Simas Corporation (Pty) Ltd, registration number 2019/162925/07, trading as Femagraphy (“Femagraphy”, “we”, “us”, or “our”), through https://femagraphy.co.za/ and any related sales channels operated by Femagraphy.

1. General Policy Position

Femagraphy operates on a strict no-refund policy except where:

  • a refund, return, repair, replacement, or cancellation right is required by applicable law; or
  • Femagraphy chooses, in its sole discretion, to grant relief in a particular case.

Where Femagraphy approves any non-statutory return, cancellation adjustment, goodwill remedy, or refund request, the relief will ordinarily be provided as store credit only, and not as a cash refund.

2. Your Statutory Rights Are Preserved

Nothing in this Policy limits or excludes any rights that you may have under applicable South African law.

Where the law requires a refund, repair, replacement, return right, or other remedy, that legal right will apply notwithstanding anything else in this Policy. This includes, where applicable, rights relating to defective goods, cancellation of advance bookings or orders, direct marketing rescission, and certain electronic transactions.

3. Digital Products, Digital Access, and Online Content

Subject to applicable law, all purchases of digital products are final once access has been granted, the content has been delivered, or the digital item has been downloaded, streamed, unlocked, or otherwise made available.

This includes, where applicable:

  • digital image sets;
  • digital downloads;
  • digital magazines or digital issues;
  • paid galleries;
  • memberships or subscription access;
  • video content;
  • online passes;
  • downloadable files; and
  • any other digital access product.

Because digital products can usually be accessed, copied, consumed, or retained immediately, Femagraphy does not offer discretionary returns or cash refunds for these products once access or delivery has occurred.

If Femagraphy agrees to provide a remedy for a digital-content issue on a discretionary basis, that remedy will ordinarily be issued as store credit only.

4. Physical Products

Subject to applicable law, physical items may only be considered for return where:

  • the item was damaged on arrival;
  • the wrong item was supplied;
  • the item is materially defective;
  • the item materially does not match the approved description or order; or
  • Femagraphy otherwise agrees in writing to accept a return.

Discretionary returns are generally not accepted for:

  • opened, used, worn, washed, altered, or damaged items;
  • items not in their original saleable condition;
  • made-to-order, custom-made, personalised, or special-order goods;
  • intimate, hygiene-sensitive, or body-contact products where resale is inappropriate after opening or use;
  • clearance or defect-disclosed items sold on a clearly disclosed basis; or
  • any product excluded by law from cooling-off or return rights where those exclusions lawfully apply.

Where a discretionary return is approved, the remedy will generally be store credit only.

5. Defective, Unsafe, or Incorrect Goods

If you receive goods that are defective, unsafe, damaged on arrival, or materially incorrect, please contact us as soon as reasonably possible at info@femagraphy.co.za with:

  • your full name;
  • order number;
  • contact details;
  • a clear description of the problem; and
  • photographs where relevant.

Where goods qualify for a legal remedy, Femagraphy will deal with the matter in accordance with applicable law. South African law includes an implied warranty that goods supplied to a consumer must comply with the standards in section 55 of the CPA, and within six months the consumer may return qualifying defective goods and direct the supplier to repair, replace, or refund.

6. Services and Access-Based Products

Where Femagraphy supplies services, memberships, subscriptions, access-based products, bookings, or creative-access products, any cancellation, interruption, or service complaint will be handled subject to:

  • the Terms and Conditions;
  • any specific product terms shown at checkout;
  • the nature of the service or access already provided; and
  • applicable law.

Where Femagraphy fails to perform services to the required legal standard, South African law may entitle the consumer to require the defect to be remedied or to receive a reasonable refund to the extent of the failure.

7. Cancellations Before Dispatch or Delivery

If you want to cancel an order before dispatch, fulfilment, download, or access is granted, you must contact us immediately at info@femagraphy.co.za.

If the order has not yet been processed, dispatched, produced, fulfilled, or unlocked, Femagraphy may, in its discretion:

  • cancel the order;
  • deduct any reasonable costs already incurred;
  • issue the balance as store credit; or
  • where required by law, provide the legally required refund or remedy.

Under the CPA, consumers generally have a right to cancel an advance booking, reservation, or order, but suppliers may require a reasonable deposit and may impose a reasonable cancellation charge in appropriate cases; special-order goods are treated differently.

8. Direct Marketing and Cooling-Off Rights

Where a transaction gives rise to a statutory cooling-off or rescission right under applicable law, that right will apply in accordance with the law.

For example:

  • the CPA provides a cooling-off right for transactions resulting from direct marketing, subject to its rules and timing requirements; and
  • ECTA provides a seven-day cooling-off right for certain electronic transactions, but with important exclusions, including services started with the consumer’s consent, personalised goods, goods that cannot be returned, unsealed audio/video/software, and certain books, periodicals, magazines, and date-specific leisure or accommodation-related services.

Where a statutory right applies and the law requires money to be returned, Femagraphy will comply with that obligation.

9. Store Credit Policy

Where store credit is issued by Femagraphy, the following terms apply unless otherwise stated in writing:

  • store credit is issued in South African Rand (ZAR);
  • store credit may be used only on eligible purchases from Femagraphy;
  • store credit is not redeemable for cash;
  • store credit is not refundable;
  • store credit is not transferable without our written consent;
  • store credit may be used in full or in part until exhausted;
  • if an order paid with store credit is later cancelled or adjusted, any approved value may be re-issued as store credit;
  • store credit may not be sold, exchanged, or treated as legal tender; and
  • store credit will expire 12 months from date of issue unless a different validity period is stated at the time it is issued.

Femagraphy may refuse, cancel, reverse, or restrict store credit where fraud, abuse, duplication, error, chargeback misuse, or unlawful activity is suspected.

10. Shipping, Courier, and Return Costs

Unless the law requires otherwise:

  • original delivery charges are non-refundable;
  • return shipping costs are for the customer’s account where a return is requested on a discretionary basis;
  • if the return is due to our error, an incorrect item, or a qualifying defect, return logistics will be handled as required by law or as agreed with you in writing;
  • any store credit issued may exclude courier fees, handling fees, duties, taxes, payment-processing costs, or third-party service costs already incurred, unless the law requires otherwise.

11. Items Sent Back Without Approval

Do not send products back without first contacting Femagraphy and receiving return instructions.

Unauthorized returns may be refused, returned to sender, or held pending collection at your cost and risk.

12. Inspection and Processing

Where a return is received, Femagraphy may inspect the item or issue before deciding whether:

  • the product qualifies for a legal remedy;
  • the product qualifies for discretionary store credit;
  • the claim should be rejected; or
  • further information is required.

Any abuse of this Policy, including false defect claims, item-swapping, excessive return conduct, piracy-related refund claims, or chargeback misuse, may result in refusal of future orders, suspension of access, or further action.

13. Chargebacks and Payment Reversals

You agree not to initiate a chargeback or payment reversal dishonestly or abusively.

If a chargeback or reversal is initiated in respect of a valid transaction, Femagraphy may:

  • suspend your account;
  • revoke digital access;
  • cancel pending orders;
  • set off any store credit or outstanding amounts where lawful; and
  • defend the dispute using transaction and delivery records.

Nothing in this clause limits any lawful right you may have to dispute an unauthorized or unlawful charge.

14. How to Request a Return Review or Store Credit

To request review of a return, defect claim, delivery issue, or store-credit request, email:

Please include:

  • full name;
  • order number;
  • product name;
  • date of purchase;
  • reason for the request; and
  • photographs or supporting material where relevant.

15. Changes to This Policy

Femagraphy may amend this Returns / Store Credit Policy from time to time. The latest version will be published on the website with the updated effective date.
